TERMS OF USE (Terms of Use)


a) The website is a site operated by LearnEx Education. LearnEx Education’s principal place of business is in Persequor, Lynwood, Pretoria.
b) In the event of any comments or questions concerning the Terms of Use, please contact us by e-mailing us at info@learnex.co.za.


c) Account: means an account to the website, where you have filled in your details in order to login;
d) Users: Students, Teachers or Institutions who have been authorised to access the Online Products.
e) Institution: is the school or institution though which students have access to the Online Products;
f) Online Product: The online product you have purchased. This includes course material, components and/or quizzes and assignments, delivered via the website for use by authorised users;
g) Students: Individuals who have signed up for an account to become a user.


h) Whilst we will try our best to make sure the website, and any content on it, will be available or be uninterrupted, we will not be liable to you if for any reason the website is unavailable at any time or for any period.


i) You must keep your username, password or any other piece of information used as a part of our security procedures as confidential. You must not disclose it to any third party. j) We have the right to disable any username or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of this Terms of Use. k) If you know or suspect that anyone other than you knows your username and password, please promptly notify us at: info@learnex.co.za


l) As a Student, subject to the other sections within the Terms of Use, you may: 1.1. Access, search and view the online products and website; 1.2. View progress results; and/or download and print the online product for educational use only;


m)Whether You make use of a feature that allows you to upload content to the website, or to make contact with other users of the website, you must ensure contributions: 1.1. are accurate; 1.2. comply with applicable law in any country from which they are posted; 1.3. do not contain any material which is defamatory of any person; 1.4. do not contain any material which is obscene, offensive, hateful or inflammatory; 1.5. do not promote violence; 1.6. do not promote sexually explicit material; 1.7. do not promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, age or otherwise; 1.8. will not infringe any copyright, database right or trade mark of any other person or company; 1.9. do not promote illegal activity; 1.10. are not threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety; 1.11. do not advocate, promote or assist any unlawful act such as copyright infringement or computer misuse; n) Any content you upload to the website will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute and disclose to third parties any such content for any purpose. o) The views expressed by other authorized users on the website do not represent our views or values.


p) Unless provided otherwise, we are the owner of all intellectual property rights in the website and online products, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. q) You may print off one copy, and may download extracts, or any page(s) from the website for your personal use; r) You must not modify the paper or digital copies of any materials you have printed or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. s) You must not use any part of the content on the website or online products for commercial purposes without obtaining a license to do so from us.


t) Where the website contains links to other websites and resources provided by third parties, these links are provided for your information only. u) We have no control over the contents of those websites or resources.


v) We shall be permitted to use statistical data arising out of use of this website by an End User. We undertake to use this data only for internal editorial purposes, academic research purposes and to monitor the use of this website. We may pass this data to any of our branches worldwide. No personal data will be included in this statistical data and the privacy policy will remain in force.

w) In the event that we decide to collect certain information from you, we shall also be permitted to use certain information from any content or material uploaded onto the website by the authorised users (namely language, age band and nationality). This data will only be used by us for the purposes of research and development. x) We may grant third parties access to some or all of the data collected from the content or material uploaded onto the Website for research, teaching and development purposes, or may license third parties the right to use such data in third party publications. Where content or material uploaded onto the Website by authorised users is provided to third parties, it shall be anonymised before being sent to them.
